She signed a lease of 400 euros a month, which the owners renewed up to five times; and has been paying all monthly payments until 2019, when BBVA sent her a notification informing her that the property was seized. Thatâs when she realized she had signed fake contracts.
Although a good part of the families signed a contract, some occupied the empty flats and others only reached a verbal agreement.
Nelly, another neighbor who lives there with her partner and their children, aged one, four and seven â the eldest has functional diversity â experienced a very similar situation. In 2015, she signed a contract with a person linked to the builder and for almost two years she was paying 350 euros in rent. âOne day the police came home and I realized that everything had been a scam,â she recalls.
Although a good part of the families signed a contract, some occupied the empty flats and others only reached a verbal agreement. This is the case of Sandra, who is four months pregnant; and his two minor children, who for a year and a half were paying between 200 and 350 euros in rent to the landlord.
âWe agreed that we would pay him what we could. Then, two BBVA or Divarian workers came yo our home to tell us we had to leave,â she explains.

The fact that many families did not sign a contract and that the new or continuity contracts were not formalized in any register, because the estate was no longer owned by SĂĄez, but by BBVA and, later, also by Cerberus, has meant that the courts do not recognize the right of those affected to continue living in their homes.
So, after approving a 20-day postponement, they have set their eviction for December 9, amid the health emergency and the curfew.

Es tracta de la companyia creada pel BBVA i el fons voltor estatunidenc Cerberus Capital Management, que en lâany 2018 va tancar els seus comptes a lâEstat espanyol amb uns beneficis de mĂ©s de 274 milions dâeuros. Segons es recull a la seua pĂ gina web, tĂ© almenys 3.561 immobles repartits entre Barcelona i ValĂšncia i, junt amb Blackstone, Ă©s el major inversor en el mercat de la rajola espanyol, amb vora 50.000 milions dâeuros invertits en els darrers anys.
Davant lâespeculaciĂł amb lâhabitatge per part dâaquest gran tenidor, aquest dilluns, a Barcelona, el moviment Guerra a Cerberus va plantar-li cara amb una acciĂł a la seu dâHaya Real Estate âsocietat creada per Cerberus per gestionar i comercialitzar els immoblesâ, mentre que a ValĂšncia, aquest dimecres, la PAH i EntreBarris han convocat una mobilitzaciĂł, des de la seu del PSOE fins a la seu dâHaya Real Estate ubicada a lâavinguda Cardenal Benlloch, passant per lâAjuntament de ValĂšncia i la seu del BBVA del carrer Joan dâĂustria, per aturar el desnonament de 38 famĂlies de la Pobla de Vallbona (Camp de TĂșria).
En total, sĂłn 94 veĂŻnes âentre les quals hi ha 25 menors, tres persones amb diversitat funcional i una dona embarassadaâ afectades que hi viuen en dos blocs al barri conegut com a lâErmita: al nĂșmero 108 del carrer Sant SebastiĂ i al 99 B del carrer Argila. AmbdĂłs edificis van ser construĂŻts en lâany 2009 per part de lâempresa SĂĄez Construcciones, dels empresaris JosĂ© David SĂĄez Pascual i Maria del Carmen Pascual GĂĄlvez; i a poc a poc, començaren a ser habitats per famĂlies amb una situaciĂł econĂČmica vulnerable.
Cristina PĂ©rez âqui prefereix utilitzar un nom ficticiâ va ser una de les primeres a instal·lar-sâhi, junt amb els seus dos fills menors dâedat. Va signar un contracte de lloguer de 400 euros al mes, el qual els propietaris seâl van renovar fins a cinc vegades; i ha estat pagant totes les mensualitats fins a lâany 2019, quan el BBVA li va enviar una notificaciĂł en quĂš se li comunicava que la finca estava embargada. Ăs llavors quan es va adonar que havia signat contractes falsos.

En lâany 2015, va signar un contracte amb una persona vinculada a la constructora i durant quasi dos anys va estar pagant 350 euros de lloguer. âUn dia va vindre la policia a casa i em vaig adonar que tot havia sigut una estafaâ, recorda.
Tot i que una bona part de les famĂlies signaren un contracte, algunes ocuparen els pisos buits i unes altres nomĂ©s van arribar a un acord verbal. Ăs el cas de Sandra, embarassada de quatre mesos; i els seus dos fills menors dâedat, qui durant un any i mig van estar pagant entre 200 i 350 euros de lloguer al propietari. âVam acordar que li pagarĂem el que poguĂ©rem. DesprĂ©s, dos treballadors del BBVA o Divarian van vindre a casa per dir-nos que havĂem de marxarâ, explica.

El fet que moltes famĂlies no signaren un contracte i que els contractes nous o els de continuĂŻtat no estigueren formalitzats en cap registre, perquĂš la finca ja no era propietat de SĂĄez, sinĂł del BBVA i, mĂ©s tard, tambĂ© de Cerberus, ha comportat que els jutjats no reconeguen el dret de les afectades a continuar vivint en els seus habitatges.
AixĂ doncs, desprĂ©s dâaprovar un ajornament de 20 dies, han fixat el seu desnonament el prĂČxim 9 de desembre, enmig de lâemergĂšncia sanitĂ ria i el toc de queda. Per a JosĂ© Luis GonzĂĄlez, un portaveu de la PAH a ValĂšncia, el capital âestĂ utilitzant tots els seus mecanismes per desnonar aquestes famĂliesâ. âPrimer, amb uns contractes falsos, i desprĂ©s, a travĂ©s de lâentramat de BBVA, Divarian, Cerberus i Haya, perquĂš no volen donar resposta a aquestes famĂliesâ, rebla amb rotunditat.

Per la seua part, tant la Conselleria dâHabitatge, en mans de RubĂ©n MartĂnez Dalmau (Unides Podem); com lâAjuntament de la Pobla, dirigit per Josep Vicent Garcia i Tamarit (CompromĂs), sâhan preocupat per la situaciĂł de les famĂlies i asseguren que estan en contacte amb la gestora i que sâestĂ treballant per a negociar una soluciĂł, que passaria per la suspensiĂł del llançament i la recerca dâuna alternativa habitacional, bĂ© en el mateix edifici o en un altre immoble.
Una vulnerabilitat amb molts requisits
Les famĂlies han estat movent cel i terra per trobar una alternativa a la Pobla de Vallbona, fet que passa desapercebut per a lâactual propietat i els serveis socials, que en la majoria de casos no tenen proves dâaquest interĂ©s a trobar una soluciĂł dins de la legalitat. âHem mirat altres pisos, perĂČ costen 400 o 500 euros al mes i jo no em puc permetre aixĂČâ, lamenta Cristina, qui en lâactualitat tĂ© una nĂČmina de 500 euros al mes i la seua parella guanya al voltant de 200 euros en negre. Nelly i Sandra es troben en la mateixa situaciĂł. La primera cobra 600 euros i la segona 800, entre la prestaciĂł de lâingrĂ©s mĂnim vital i els diners que guanya la seua parella com a guixaire.
Com passa sempre, a les afectades que han intentat buscar una alternativa, a banda de demanar-los una renda que no poden fer front, tambĂ© els han exigit presentar un contracte laboral i les Ășltimes nĂČmines; uns requisits que no poden complir, ja que la gran majoria sâhan vist abocades a lâeconomia submergida desprĂ©s de la crisi financera de lâany 2008. El mateix decret llei, que es va publicar al ButlletĂ Oficial de lâEstat (BOE) lâ1 dâabril, defineix quĂš Ă©s una situaciĂł de âvulnerabilitatâ i, per tant, en quines circumstĂ ncies una llogatera es pot acollir a la prĂČrroga: a causa de la pandĂšmia, ha dâhaver passat a una situaciĂł de desocupaciĂł, estar afectada per un expedient temporal de regulaciĂł dâocupaciĂł (ERTO), haver reduĂŻt la seua jornada per motius de cures o trobar-se en unes altres circumstĂ ncies que hagen suposat âuna pĂšrdua substancial dâingressosâ.
AixĂ mateix, el conjunt dels ingressos de la unitat familiar, en el mes anterior a la sol·licitud de la prĂČrroga, no pot superar el lĂmit de tres vegades lâindicador pĂșblic de renda dâefectes mĂșltiples mensual (IPREM), el qual se situa en 537,84 euros al mes; per tant, serien 1.613,52 euros.

Lâentramat BBVA, Cerberus, Divarian i Haya
Lâoctubre de 2018, el BBVA va vendre part dels seus actius immobiliaris al fons dâinversiĂł Cerberus, un dels principals competidors de Blackstone; i van crear una companyia per gestionar-los: Divarian Propiedad SA, amb vincles a BulgĂ ria a travĂ©s del seu president i prĂncep de BulgĂ ria, Konstantin Assen Sajonia. El 80% dels actius de Divarian sĂłn propietat de Cerberus, gestionat a lâEstat espanyol pel fill major de lâexpresident espanyol JosĂ© MarĂa Aznar, JosĂ© MarĂa Aznar Botella, a travĂ©s dâHaya Real Estate; mentre que el banc conserva el 20%.
