Lyudmyla Shandyha, head of the Free Trade Union of Railway Workers of Ukraine for Transport Workers (KVPU) in Khmelnytsky region, received a letter from the office of the security service (SBU) of Khmelnytsky region.
In this document, the First Deputy Head of the Department V. Grechanyuk asks the head of the union to provide information (name, surname and positions held) of the members of the Free Trade Union of Railwaymen of Ukraine in Khmelnytsky, referring to paragraph 5 part 2 of article 7 of the Law of Ukraine “On counter- intelligence activities”. After consulting the Secretary of the Free Trade Union of Railway Workers of Ukraine, Volodymyr Kozelsky, and the legal department of the Confederation of Free Trade Unions of Ukraine, Lyudmyla Shandyha reminded the SBU official in her reply that his request violates the Constitution of Ukraine. In view of all this, Lyudmyla Shandyha rightly replied that he considered it impossible to provide such information on trade union members.
As other local, regional and branch trade union organisations may be in a similar situation, we provide the comments of the legal department of the Confederation of Free Trade Unions of Ukraine on this issue. [See KVPU]
